Terms and Conditions – PHOL-LABS Kft

(General Terms and Conditions / Általános Szerződési Feltételek – ÁSZF)

These Terms and Conditions (General Terms and Conditions / Általános Szerződési Feltételek – ÁSZF) govern all purchases made through the webshop operated by PHOL-LABS Kft. (PHOL-LABS LLC). By placing an order on the Website, the Buyer accepts these Terms.

2. Scope and General Provisions

2.1. These Terms apply to all electronic commerce services and purchase contracts concluded via the Website.
2.2. Orders may be placed electronically through the Webshop.
2.3. The contract language is English. Hungarian legal terminology (e.g. ÁSZF) may be indicated in brackets for reference.
2.4. We do not adhere to any voluntary industry code of conduct unless explicitly stated on the Website.


3. Product Information, Condition, Intended Use

3.1. Essential characteristics and specifications of products are displayed on the relevant product pages.
3.2. Products may be sold as New/NOS (New Old Stock), Refurbished/Used, Automotive electronic parts, or DIY/PCB modules. Cosmetic wear, storage aging, or reduced expected service life of NOS/refurbished items do not constitute defects if disclosed.
3.3. Many products are technical components intended for professional or experienced users. The Buyer is responsible for verifying compatibility and correct installation. We do not guarantee that a product will resolve a specific fault or diagnostic code.


4. Prices and Availability

4.1. Prices displayed are gross prices including VAT unless stated otherwise. Shipping costs are shown during checkout.
4.2. We reserve the right to change prices. Price changes do not affect already confirmed orders.
4.3. In case of obvious pricing errors, we may refuse fulfillment at the incorrect price and offer fulfillment at the correct price or cancel the order with a refund.


5. Ordering Process and Contract Formation

5.1. The Buyer places products into the cart and submits the order via checkout.
5.2. By submitting the order, the Buyer makes a binding offer and acknowledges that the order may create a payment obligation.
5.3. An automatic e-mail confirms receipt of the order.
5.4. A binding contract is formed upon our order confirmation or dispatch of the goods.
5.5. We may refuse orders due to unavailability, payment failure, delivery restrictions, or suspected misuse. Any paid amounts will be refunded without undue delay.


6. Payment

6.1. Available payment methods are shown during checkout.
6.2. Payment card data is processed by third-party payment providers; we do not store full card details.


7. Shipping and Dispatch Timeframes

7.1. In-stock products: Dispatch of products marked as “in stock” is performed within 7 business days after order confirmation.
7.2. Cars category: Products in the category “Cars” are dispatched within 1 calendar month after order confirmation.
7.3. Delivery times are estimates and may vary depending on destination, carrier, and external circumstances.


8. Backorders

8.1. Certain products may be offered on a backorder basis.
8.2. The expected fulfillment period for backorders is up to 180 days from order confirmation.
8.3. Shorter estimated timeframes may be communicated to the Buyer by e-mail or on the product page; such estimates are provided for information only and do not constitute a binding delivery deadline.
8.4. If fulfillment becomes impossible or unreasonably delayed, the Buyer will be informed and any payments made will be refunded in accordance with applicable law.
8.5. The Buyer may cancel a backorder prior to dispatch. Statutory consumer rights in case of delay remain unaffected.


9. Delivery and Delay

9.1. Unless otherwise agreed, we aim to deliver within 30 days from contract formation. Generally, we dispatch within 7 working days from the order date, except the “Cars” item category
9.2. If delivery is delayed, the Buyer may set an additional reasonable deadline. If we fail to perform within that deadline, the Buyer may withdraw from the contract in accordance with applicable law.


10. Right of Withdrawal (EU Consumers)

10.1. Consumers have the right to withdraw from the contract within 14 days of receipt without giving any reason.
10.2. The Buyer bears the cost of return shipping unless mandatory law provides otherwise.
10.3. The Buyer is liable for any diminished value resulting from handling beyond what is necessary to inspect the goods.
10.4. Refunds are made within 14 days after receipt of the returned goods or proof of return.
10.5. For non-EU returns, parcels must be marked as “Returned Goods”. Any customs or import charges due to incorrect declaration are borne by the Buyer.

11. Warranty and Legal Guarantee

11.1. Consumers benefit from statutory rights for non-conforming goods under EU and Hungarian law (including kellékszavatosság).
11.2. Repair or replacement may be offered in accordance with applicable law.
11.3. Exclusions apply to defects caused by misuse, improper installation, modifications, normal wear and tear, liquid or electrical damage, or incompatibility not explicitly guaranteed.

11.4. Software / Firmware

Embedded software and firmware are provided “as is”. Minor bugs, feature limitations, or compatibility issues do not constitute non-conformity if the product substantially performs the functions described at the time of sale. Malfunctions caused by custom firmware or unauthorized modifications are excluded.


12. B2B Purchases

Consumer-specific rights (such as the 14-day withdrawal right) do not apply to business customers. For B2B orders, warranty and return terms may differ to the maximum extent permitted by law.


13. Liability

To the maximum extent permitted by law, we are not liable for indirect or consequential damages. Nothing in these Terms excludes liability that cannot be excluded under mandatory law.


14. Intellectual Property

All Website content is protected by intellectual property laws. Any use beyond private use requires prior written consent.


15. Complaints and Dispute Resolution

15.1. Complaints can be submitted by e-mail to: admin@phol-labs.com
15.2. If a consumer dispute cannot be resolved amicably, the Buyer may also contact:

  • the competent consumer protection authority, and/or
  • a conciliation body (in Hungary: Békéltető testület).

15.3. Consumers may also use the EU Online Dispute Resolution (ODR) platform (where applicable).


16. Governing Law

These Terms are governed by Hungarian law, with mandatory EU consumer protection rules applying where relevant.


17. Amendments

We may amend these Terms at any time. The version published at the time of ordering applies to that order.
